We’re excited to announce the passage of House Bill 46 (HB 46), a groundbreaking expansion of the Texas Compassionate Use Program (TCUP) that marks a significant moment for medical marijuana patients across the state. Key Highlights of HB 46

Expanded Patient Access and Prescription Flexibility

  • Prescriptions: Patients will now be eligible for one-year prescriptions with up to four 90-day refill authorizations. All prescriptions will be monitored through the TCUP registry managed by the Texas Medical Board (TMB).
  • New Qualifying Conditions: Patients with chronic pain, traumatic brain injury (TBI), Crohn’s disease/IBD, degenerative disc disease, glaucoma, and those receiving hospice or palliative care will now qualify. The program continues to cover PTSD and other neurological conditions, and the state may expand the list over time.
  • Wider Range of Product Formats
  • Approved formats now include patches, lotions, suppositories, and inhalation devices such as vaporizers, inhalers, and nebulizers, giving patients faster and more flexible options for relief.
  • THC Limits: Products will now be regulated by dose strength (not percentage), with 10 mg THC per dose and 1,000 mg THC per package. Inhalable products are exempt from the 1% THC limit to allow for more effective therapeutic use.
  • Only naturally occurring cannabinoids are permitted under the new guidelines.

  • The number of dispensing organizations will increase from 3 to 15 statewide, with new licenses issued by December 1, 2025 and additional licenses by April 1, 2026.

  • Licensed organizations will be allowed to open multiple satellite pickup locations across the state, pending approval by the Department of Public Safety (DPS). These locations will help ensure that every region in Texas, including rural areas, has reliable access.
  • Existing pickup sites will automatically transition to satellite status under the new rules.
  • With the approval of overnight storage, we’re excited about the potential to expand delivery and offer faster, more reliable service to even more Texans.

Pulmonary Inhalation Products

  • Devices like vaporizers and inhalers are expected to become available after final rulemaking is completed by October 1, 2025. We’re actively working with state agencies to ensure we’re ready to launch these products once approved.

  • While some formats, such as smokable flower, still require further clarity under Texas law, we remain committed to working with regulators to understand what may be permitted in the future.
